November 19, 2018 City Council Special Meeting Minutes

2:30 P.M.

 

A special meeting of the City Council of the City of International Falls, Minnesota was held in the Council Chambers of the Municipal Building on the 19th day of November, 2018. Mayor Anderson called the meeting to order at the hour of 2:30 P.M.

 

MEMBERS PRESENT:     Councilors Briggs, Droba, Krause, Jaksa, and Mayor Anderson

MEMBERS ABSENT:     None

OTHERS PESENT:        Samantha Butts, Joe Schwartz, Zachary Scofield, Adam Mannausau, Betty Bergstrom and Ken Anderson

 

APPROVED recessing Open meeting to conduct a Closed meeting

MOTION by Councilor Droba to recess the Open meeting to conduct a Closed session for two purposes:

  1. Considering an employee request to extend FMLA leave and to discuss health or medical data that are not public data per Minnesota Statute, 13D.05, Subd. 2 (3); and
  2. Further in closed meeting, consider strategies for labor negotiation development(s) and proposal(s) per Minnesota Statute, 13D.03, Subd. 1 (b).

Motion seconded by Councilor Jaksa and carried unanimously at 2:34 P.M.

   

ADJOURN the Closed meeting session and reconvene in Open meeting session

MOTION by Councilor Droba to adjourn the Closed meeting session and reconvene in Open meeting session. Motion seconded by Councilor Krause and carried unanimously at approximately 4:05 P.M.

   

APPROVED Employee Return to Work for Light Duty Office/Clerical Work Only

MOTION by Councilor Briggs to approve the employee to return to work for light duty office/clerical work only, subject to waiving any obligation of the City to pay for costs if the diagnosed injury is aggravated or worsened as a result of employee performing light duty office/clerical work; and furthermore, to approve unpaid leave of absence from the expiration date of FMLA in accordance with the following terms and conditions:

  1. Perform light duty work per health provider updated limitations for up to 8 hrs. per day, 40 hrs. per week.
  2. Employer payment of health insurance and life insurance per terms of collective bargaining agreement (Employee can be required to reimburse employer for said expenses).
  3. Employee shall be required to use accrued sick leave balance for absences (0 hours currently).
  4. Unpaid leave expires the earlier of February 15, 2019 or return to normal work duties with no limitation as approved in writing by health care provider’s authorization submitted to the employer.
  5. Employee affirmatively waives all future claims against the City and will not require the City to assume any liability if the existing injury is aggravated because of this light duty work.

Motion seconded by Councilor Jaksa and carried unanimously.

   

ADJOURNMENT
