December 3, 2020 Special City Council Meeting Minutes
5:00 P.M.
A special meeting of the City Council of the City of International Falls, Minnesota was held in the Council Chambers of the Municipal Building and via BlueJeans Conferencing on the 3rd day of December, 2020 at the hour of 5:00 P.M.
MEMBERS PRESENT: Councilors Buller, Ditsch, Krause and Mayor Droba.
Media and public via BlueJeans Conferencing. All members noted they could hear the others and the discussion.
MEMBERS ABSENT: Councilor Briggs.
APPROVED terminating the contract with Drain Services, Inc. to perform CIPP work per General Conditions, Section 16.03 Owner May Terminate for Convenience |
City Administrator Anderson explained that the City Engineer recommended terminating the contract with Drain Services, Inc. for the CIPP work to be performed on the sanitary sewer collection system. Drain Services, Inc. is requesting additional money to perform the work. City Engineer indicated the contract can be terminated per the General Conditions, Section 16.03 Owner May Terminate for Convenience. Per Section 16.03, the Owner will pay for the completed and acceptable work executed in accordance with the contract documents.
Bryan Bye from Widesth explained that Drain Services, Inc. is requesting a substantial amount of money outside of the original contract to complete the project. This would put the City outside of their budget planned for the project. For example, the proposed pricing for grout services is ten time the norm for this work.
Public Works Director stated that they were requesting an additional $600,000.00. Drain Services, Inc. was the lowest bid of four originally received. Widseth researched and confirmed that Drain Services, Inc. was a reputable company to perform the work since they were to have factory representatives present when the work was to be done. He said the date for substantial completion was October 23, 2020 and the change order proposal was not received until October 26.
MOTION by Councilor Buller approving terminating the contract with Drain Services, Inc. for performing CIPP work per General Conditions, Section 16.03 Owner May Terminate for Convenience. Final bill from Drain Services, Inc. to be reviewed by Council prior to payment. Motion seconded by Councilor Krause and carried unanimously. |
