October 4, 2021 City Council Minutes

A regular meeting of the City Council of the City of International Falls, Minnesota was held in the Council Chambers of the Municipal Building on the 4th day of October, 2021 at the hour of 5:30 P.M.

MEMBERS PRESENT:       Councilors Buller, Ditsch, Holden, Krause, and Mayor Droba.

MEMBERS ABSENT:         None.

 

APPROVED agenda with additions MOTION by Councilor Holden to approve the agenda with additions, as presented:

·         Consent Agenda Item – Approve Patrol Officer Dustin Helgeson’s separation from employment effective October 1, 2021

·         New Business Item – Approve Police Chief’s recommendation to hire part-time Patrol Officer Ryan Stenson to full-time Patrol Officer vacancy effective October 5, 2021

APPROVED minutes of the September 27, 2021 special City Council meeting MOTION by Councilor Krause to approve minutes of the special City Council meeting of September 27, 2021.  Motion seconded by Councilor Buller and carried unanimously.
   
ADOPTED Resolution No. 66-2021 approving transfers, payment of claims, and accounts payable MOTION by Councilor Krause to adopt Resolution No. 66-2021 approving transfers, payment of claims and accounts payable for the first monthly City Council meeting.  Motion seconded by Councilor Buller.  Councilor Krause noted that much of the Airport accounts payable claims are reimbursable.  Councilor Buller stated that 95 percent is reimbursed by the FAA and the remaining 5 percent will be reimbursed from a special FAA grant.  Motion carried unanimously.

OLD BUSINESS:  
Allison O’Hara Meyers, Director of Operations for Northland Counseling Center Allison O’Hara Meyers, Director of Operations for Northland Counseling Center, was present to clarify misconceptions and concerns raised at the September 20, 2021 City Council meeting regarding the Conditional Use Permit application for Northland Counseling Center to conduct a Licensed Adult Foster Care at 122 Park Avenue.

Ms. O’Hara Meyers noted that Northland Counseling Center has provided mental health services to the International Falls community since 1959, and currently employs 40-50 people, with plans for additional positions after they complete renovations to their larger office space.  Ms. O’Hara Meyers demonstrated the numerous charitable endeavors and donations Northland Counseling participates in within the community.  Ms. O’Hara Meyers explained that someone demonstrating a mental illness does not correlate to being dangerous or a sex offender, and further explained that people seeking mental health services are statistically less likely to become violent.  Ms. O’Hara Meyers listed various forms of mental illness that would result in someone seeking treatment from Northland Counseling Center including but not limited to: anxiety, depression, substance abuse, eating disorders, PTSD, and behavioral and emotional disorders in children.  Ms. O’Hara Meyers stressed that mental illness does not discriminate and it affects many people both young and old and by stigmatizing mental illness, it discourages people to seek help and services for their mental health issues.  Ms. O’Hara Meyers stated that any consideration of a sex offender ordinance to restrict residency of sex offenders within the City of International Falls should be considered separate from the Conditional Use Permit for Northland Counseling because they are not in any way correlated and it presents a dangerous narrative pairing the two items.

   
REMOVE from the Table and APPROVED Conditional Use Permit for Licensed Adult Foster Care Councilor Krause noted that he would be abstaining from these discussions, as he is employed by Northland Counseling Center.

MOTION by Councilor Ditsch to remove from the Table the item to consider a recommendation from Planning Commission to approve Conditional Use Permit for Licensed Adult Foster Care.  Motion seconded by Councilor Buller.  Motion passed 4-0-1 with Councilors Buller, Ditsch, Holden, and Mayor Droba voting “yea” and Councilor Krause abstaining.

MOTION by Councilor Buller to approve the Conditional Use Permit for a Northland Counseling Center to conduct Licensed Adult Foster Care at 122 Park Avenue.  Motion seconded by Councilor Ditsch.

City Attorney Shermoen stated that he was contacted by Planning Commission chairman, Matthew Gouin, after the September 20, 2021 City Council meeting, where this item was tabled.  Mr. Shermoen explained to Mr. Gouin that the City Council tabled the item in order to gather additional information.  Mr. Shermoen encouraged Mr. Gouin to elaborate the Planning Commission meeting minutes to indicate the Planning Commission’s findings on the matter of the Conditional Use permit and how the Planning Commission arrived at their recommendation.  Mr. Gouin and the Planning Commission provided more detailed revised minutes of their meeting detailing the facts and findings that supported their recommendation that the City Council approve the Conditional Use Permit for Northland Counseling Center to conduct Licensed Adult Foster Care at 122 Park Avenue.  Mr. Shermoen gave his legal opinion that previous concerns raised about the Planning Commission not meeting quorum requirements were invalid, as there were vacancies on the Commission that reduced the number of members required to be present for the meeting.

Motion passed 3-1-1 with Councilors Buller, Ditsch, and Mayor Droba voting “yea”, Councilor Holden voting “nay”, and Councilor Krause abstaining.

   
CONSENT AGENDA: APPROVED as presented MOTION by Councilor Holden to approve the Consent Agenda as presented:

  1. Approve the 2022 Group BCBS Medicare Senior Gold health insurance renewal and authorize signatures
  2.  Approve Patrol Officer Dustin Helgeson’s separation from employment effective October 1, 2021

Motion seconded by Councilor Krause and carried unanimously.

NEW BUSINESS:  
APPROVED Mayoral Proclamation establishing October 2020 as Domestic Violence Awareness Month MOTION by Councilor Holden to approve the Mayoral Proclamation establishing October 20201 as Domestic Violence Awareness Month.  Motion seconded by Councilor Buller and carried unanimously.
   
APPROVED hire of part-time Patrol Officers Shane Thramer and Carter Lagergren Chief Kostiuk made recommendation to the Council to hire Shane Thramer and Carter Lagergren as part-time Patrol Officers.

MOTION by Councilor Krause to approve hiring Shane Thramer and Carter Lagergren as part-time Patrol Officers.  Motion seconded by Councilor Buller and carried unanimously.

   
ADOPTED Resolution No. 68-2021, PERA Declaration for part-time Patrol Officer Carter Lagergren MOTION by Councilor Ditsch to adopt Resolution No. 68-2021 PERA Declaration for part-time Patrol Officer Shane Thramer.  Motion seconded by Councilor Holden and carried unanimously.
   
ADOPTED Resolution No. 69-2021, PERA Declaration for part-time Patrol Officer Carter Lagergren MOTION by Councilor Holden to adopt Resolution No. 69-2021 PERA Declaration for part-time Patrol Officer Carter Lagergren.  Motion seconded by Councilor Krause and carried unanimously.
   
ADOPTED Resolution No. 70-2021 approving delinquent water and sewer accounts to be certified to the County Auditor/Treasurer There was discussion about water and sewer assessment processes, as well as delinquent disconnection procedures.  Administration Support Specialist Emma Rud explained that this year’s listing of assessments is substantially longer.  This is a direct result of no water disconnections for 18-months due to COVID-19 restrictions and those delinquent accounts requiring assessment.

MOTION by Councilor Holden to adopt Resolution No. 70-2021 approving delinquent water and sewer accounts with interest to be certified to the County Auditor/Treasurer.  Motion seconded by Councilor Krause and carried unanimously.

   
ADOPTED Resolution No. 71-2021 approving delinquent grass and blight invoices to be certified to the County Auditor/Treasurer MOTION by Councilor Ditsch to adopt Resolution No. 71-2021 approving delinquent grass and blight invoices with interest to be certified to the County Auditor/Treasurer.  Motion seconded by Councilor Krause and carried unanimously.
   
Human Resource Committee recommendation:  
a)      APPROVED termination of an Emergency Medical Technician from employment due to inactivity MOTION by Councilor Ditsch to approve termination of Whitney Gearhart, Emergency Medical Technician, from employment due to inactivity.  Motion seconded by Councilor Holden and carried unanimously.
   
APPROVED Mayor’s recommended appointments to the Planning Commission MOTION by Councilor Holden to confirm the Mayor’s appointments to the Planning Commission of Julie Ehrman, Paul Nevanen, and Leonard Peterson for three-year terms, January 1, 2021-December 31, 2023 and Michael Klaphake to fill a vacant position for a term expiring December 31, 2021.  Motion seconded by Councilor Krause and carried unanimously.
   
APPROVED Mayor’s recommended appointments to the Zoning Board of Appeals MOTION by Councilor Buller to confirm the Mayor’s appointments to the Zoning Board of Appeals of Bill Valentine to fill a vacant position for a term expiring December 31, 2022 and Jessica Crosby for a five-year term, January 1, 2021-December 31, 2025.  Motion seconded by Councilor Ditsch and carried unanimously.

Councilor Krause stressed that residents that want to become involved in various committees to reach out to the Mayor, as there will be terms expiring at the end of the year.

   
Snow Removal Policy Update Mayor Droba requested that the Snow Removal Policy be placed on the next City Council meeting agenda for approval.
   
REPORTS:

Reports of the Administrator, Attorney, and Department Heads

City Attorney Shermoen stated that the City is in conversations with Kootasca Community Action regarding their lease and the option for them to purchase the building from the City of International Falls.  City Attorney Shermoen also noted that the City’s bargaining agreement negotiating team is compiled and is scheduled to meet with the first bargaining unit on Wednesday, October 6, 2021.
