308.1 Accumulation of rubbish or garbage. Exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage.
308.2 Disposal of garbage rubbish. Every occupant of a structure shall dispose of all garbage and rubbish in a clean and sanitary manner by placing such garbage and rubbish in approved leakproof, covered, outside containers.
308.2.1 Garbage and rubbish storage facilities. The owner of every occupied premises shall supply approved leakproof, covered, outside containers for garbage and rubbish.
308.2.2 Dumpster Enclosures. All multi-unit dwellings and commercial establishments may store dumpsters for garbage and rubbish within an enclosure. A zoning or building permit is required for dumpster enclosures. No dumpster may be placed in any residential area for more than two (2) weeks without an appropriate permit from the City.
308.3 Removal of garbage and rubbish. The owner of the premises shall be responsible for the removal of rubbish and garbage on at least a weekly basis. The owner of every occupied premises shall receive one prior written warning of failure to remove rubbish and garbage, after which any subsequent failure to remove rubbish and garbage, the owner shall be required to contract with an approved garbage and rubbish disposal contractor. Within 14 days of notice of requirement to contract with an approved garbage and rubbish disposal contractor, the owner shall provide proof of contract.
308.3.1 Service. In the event an owner of an occupied premises is required to contract with an approved garbage and rubbish disposal contractor due to failure to remove garbage and rubbish and fails to provide proof of contract within 14 days of notice, the City of International Falls may contract with a garbage and rubbish disposal contractor for removal of garbage and rubbish from the premises in violation. The service charge for the premises in violation shall be entered, shown and placed on the monthly City Utility billing, and shall be indicated as “garbage collection charges.” All garbage collection charges shall be payable at the office of the City Administrator.
308.3.2 Fund. All service charges shall be deposited in a separate fund designated as the “Garbage Collection Fund.” All the expense of providing refuse collection service shall be paid from this fund. If the amount is insufficient to pay all such expenses, such amount as may be necessary to meet such expenses shall be transferred to the fund from the general fund.
308.3.3 Service charges. Service charges shall be payable at the same time as bills for water service and subject to the same conditions of payment. If any charge is unpaid on September 1 of any year, the Council shall levy an assessment equal to the unpaid charge as of that date plus interest at the rate of 5% from that date and a penalty of 8%. The City Administrator shall certify the assessment to the County Auditor for collection in the same manner as assessments for local improvements.
